1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the website parcelclaim.app and the AI claim-letter generation service operated by ParcelClaim ("we", "us", or "our"). By creating an account, making a purchase, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Service.
2. Description of the Service
ParcelClaim is a software tool that helps you draft professional, English-language claim letters to e-commerce platforms (Amazon, TikTok Shop, Temu, Shein, and others). The Service:
- Asks you to describe the issue with your package (late delivery, missing items, damage, wrong address).
- Matches your case to publicly known platform refund policies stored in our database.
- Uses the Google Gemini API to generate a customized English claim letter grounded in those policies.
- Lets you copy the letter so you can paste it into the platform's customer-service chat or email.
3. Accounts & Eligibility
3.1 Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3.2 Account security
You are responsible for safeguarding your account password and for any activity that occurs under your account. Please use a strong, unique password and do not share it with others. Notify us immediately at [email protected] if you suspect any unauthorized access.
3.3 Accurate information
You agree to provide accurate, current, and complete information when creating an account and to keep it updated. We may suspend or terminate accounts that contain information we reasonably believe is false, misleading, or fraudulent.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Submit fraudulent claims (e.g., claiming a package never arrived when tracking shows delivered to you).
- Use the Service to harass, threaten, defame, or impersonate any person.
- Attempt to bypass payment (e.g., by manipulating the platform, using stolen payment methods, or exploiting the VIP free-trial system).
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
- Interfere with or disrupt the Service, its servers, or any networks connected to it.
- Use the Service to generate spam, phishing content, or any other mass unsolicited communications.
- Scrape, crawl, or use automated tools to access the Service except for legitimate search-engine indexing.
- Resell, sublicense, or commercially exploit the Service or generated content without our written permission.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including reporting such conduct to law-enforcement authorities.
5. Payments & VIP Subscription
5.1 One-time letter unlock ($1.00)
The base Service is pay-per-letter. You pay a one-time fee of $1.00 via our payment processor Creem to unlock a single AI-generated claim letter. The fee is charged at the time of order creation.
5.2 VIP subscription ($4.99/month)
You may upgrade to ParcelClaim VIP for unlimited claim letters during the subscription period. VIP renews monthly at $4.99 unless canceled. New users receive a complimentary 7-day VIP trial on sign-up.
5.3 Cancellation
You can cancel your VIP subscription at any time via your profile page or the Creem customer portal. Cancellation takes effect at the end of the current billing period; you retain VIP access until then. No partial refunds are issued for mid-cycle cancellations.
5.4 Price changes
We may change the price of the Service or VIP subscription at any time. Price changes will not affect your current billing cycle and will be communicated at least 30 days before taking effect for VIP subscribers.
5.5 Taxes
Prices are exclusive of any applicable sales tax, VAT, or GST, which will be added at checkout as required by law.
6. Refunds
The $1.00 one-time unlock fee is non-refundable once the AI letter has been successfully generated and delivered.
Exception: if AI generation fails and we are unable to deliver a working claim letter, you are entitled to a full refund within 5 business days. See our full Refund Policy for details and exceptions.
7. Intellectual Property
7.1 Our IP
The Service, including its design, code, database of platform policies, trademarks, logos, and branding (excluding User Content), is owned by ParcelClaim and protected by international copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
7.2 Your generated letter
The AI-generated claim letter created for you is yours to use however you like—copy it, edit it, send it. We assign to you all our right, title, and interest in the specific letter generated for your account, subject to the underlying third-party policy excerpts (which are public-domain summaries) and the Google Gemini terms.
8. User Content
"User Content" means any text, descriptions, tags, or other materials you submit to the Service. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, and process your User Content solely to operate and improve the Service.
You represent and warrant that you have all rights necessary to submit the User Content and that it does not violate any third party's rights or any applicable law.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) the results obtained from using the Service will be accurate or reliable; (c) any refund claims you submit to platforms will be successful.
ParcelClaim is a writing tool, not a legal service. We are not your lawyer. The generated content does not constitute legal advice. If you need legal advice, consult a licensed attorney in your jurisdiction.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PARCELCLAIM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
In jurisdictions that do not allow the exclusion of certain damages, our liability shall be limited to the amount you paid us in the twelve (12) months preceding the claim, or USD $100, whichever is greater.
11. Indemnification
You agree to defend, indemnify, and hold harmless ParcelClaim and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any fraudulent claim you submit to a platform using content generated by the Service.
12. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, including (without limitation) if we believe that you have violated these Terms. Upon termination:
- Your right to use the Service will immediately cease.
- We may delete your account data, subject to our retention obligations in the Privacy Policy.
- Provisions of these Terms that by their nature should survive termination will survive (including but not limited to ownership, disclaimers, indemnification, and limitations of liability).

13. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except that we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
EU/UK users: nothing in this section affects your right to bring proceedings in your country of residence or to rely on mandatory consumer-protection laws of your country.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via a banner on the Service and (for logged-in users) via email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
